GENERAL TERMS OF USE

Please read this document carefully. It contains the Terms for accessing and using the website www.avtobus.bg. If you do not accept the Terms stated here, you are not able to use the Site! Use of the Services available without registration will be deemed to be an endorsement of these Terms.

GENERAL TERMS OF USE

Registration

1.1. “Avtobus BG” Ltd., UIC 205671635, with registered office: 54 Lev Tolstoy, entrance D, fl.1, ap. 95, Sofia 1220 ("AVTOBUS.BG" / "We" / "Us") provides via the www. AVTOBUS.BG and the mobile versions and applications (the "Site") of individuals and legal entities ("You") free information society services ("Services"). Services include, but are not limited to, opportunities to search, browse, receive, and post ads and vehicle information.

1.2. Some services, such as posting ads on the Site, require registration. Registration is free.

1.3. By attending AVTOBUS.BG and agreeing to abide by these Terms, you guarantee that you are over 18 years old and capable of entering into a contract. AVTOBUS.BG is not responsible for the use of the Services by a person who does not meet the stated age and capacity limitations.

1.4. Registration as a user is done personally by a legally competent person, and registration on behalf of other persons is not allowed. When registering a user, information such as: name, email and other information specified in the registration form are required. We only use this information in the manner set out in the Privacy Policy.

1.5. Registration as a carrier is performed personally by a legally competent person and/or by a legally competent person who declares that he or she is authorized to represent a legal entity, including accepting these Terms and performing actions related to the use and management of the carrier's account in his own name and/or on behalf of a legal entity. Registration as a carrier requires information such as: name of the person, telephone numbers, address and other information specified in the registration form, and in the case of registration of a carrier as a legal entity, information such as: name of legal entity, UIC, administrative contact person, contact numbers, address and other information provided in the registration form.

1.6. You are required to provide and maintain accurate, complete and up-to-date registration information. In case of incorrect, outdated or inaccurate data, you are obliged to correct them immediately and you are not entitled to use the Services before.

1.7. In addition to the registration information completed, AVTOBUS.BG reserves the right to request the submission of additional documents, including signed ones (manually or electronically signed), for additional identification when activating the account or at any time thereafter when doubts arise about accuracy and the completeness of the information provided.

1.8. You are responsible for all actions taken through your account using your username and password. You are obliged to immediately notify AVTOBUS.BG in case of unauthorized access or probability of such access.

Conclusion of contract

2.1. By clicking on the "Registration" button you or you and the legal entity you represent make an electronic statement concluding an agreement with AVTOBUS.BG under these Terms and you are obliged to abide by them. Before clicking on the "Registration" button, you have the opportunity to view and edit the information you provide.

2.2. You agree that the electronic statements to AVTOBUS.BG and the electronic statements from AVTOBUS.BG to you will be considered as signed by a simple electronic signature bearing the power of a handwritten signature.

2.3. Some of the Services are also provided without registration. In such cases, the acceptance of these Terms is expressed when the use of the Services begins.

2.4. In connection with the Services provided, communication between you and AVTOBUS.BG via e-mail is required. According to Art. 5 of the Electronic Document and Electronic Certification Services Act, by accepting these Terms, you agree to be the addressee of electronic statements by AVTOBUS.BG in electronic form in connection with this Agreement and the Services on the Site.

Use of the Services and Content on the Site

3.1. You agree to use the Site in accordance with these Terms, the Additional Terms and Guidelines applicable to the individual Services published on the respective pages of the Site and the applicable Bulgarian legislation.

3.2. AVTOBUS.BG assumes no responsibility for controlling the content of the advertisements and is not a mediator in the relations between the users of the Site. You accept that AVTOBUS.BG does not guarantee and cannot guarantee the booking, as well as the indicative values of the offers and the identity of the users and / or carriers with whom you may have relations. If you believe that a user and/or carrier does not comply with the agreed terms and/or its actions are not in accordance with the law, you should inform the competent institutions. Use of the service is at your own risk and responsibility.

3.3. The site and its contents are the property of AVTOBUS.BG and / or its partners, suppliers and customers. You may use the content to search for vehicles and / or contact a carrier. You may not use this content for any purpose other than the express Our consent or the third parties concerned.

3.4. You agree not to use the intended means of communication with other users for purposes other than the purpose of the Site.

3.5. You agree not to interfere with the normal operation of the AVTOBUS.BG technical or software applications and computer systems or users of the Site through fraudulent actions.

Posting ads

4.1. You take full responsibility for the ads and information you publish on the Site, and you agree that they are accurate, correct and complete.

4.2. You are required to update the information on the vehicles you have posted in the event of a change and to remove the ad if the vehicle is unavailable for any reason.

4.3. You agree not to post more than one ad for the same vehicle, ads with misleading content or for purposes other than the purpose of the Site, advertisements with impulse or foreign telephone numbers.

4.4. You agree to use the "Photo" field in the ad only for photographs of the vehicle in question. Uploading self-contained logos and other images unrelated to a specific vehicle is not permitted.

4.5. You agree not to post links and/or logos to other sites.

4.6. You agree not to post any content that is illegal, discriminatory, obscene, offensive, threatening, defamatory, hateful, or obscene, as well as content that could endanger, disparage, offend, or defame a third party legal secret.

4.7. You guarantee that you have the right to use any content you post on the Site or send to others through the Site, and that it does not contravene these Terms or the law. If this is not the case, you are liable for all damages arising out of this to AVTOBUS.BG or to third parties.

4.8. AVTOBUS.BG reserves the right to remove or request the editing of ad/ad units or other content posted by you that does not meet these Terms or the additional terms and guidelines posted on the Site.

4.9. AVTOBUS.BG reserves the right to refuse, suspend or suspend the provision of the Service:

(a) In the case of unfair behavior of the user (for example posting false or misleading ads; referral to competing sites, etc.);

(b) Upon establishment of activities similar to those performed through this Site;

4.10. In order to guarantee the reliability and security of the Services, AVTOBUS.BG reserves the right to seek the assistance of the competent authorities for gross violations of these Terms.

4.11. You authorize AVTOBUS.BG to make available (both for Bulgaria and abroad) ads and other public content, for the purpose of providing the Services and AVTOBUS.BG does not owe a fee.

4.12. By posting content on the Site, you give its users the right to access and use the Site in accordance with these Terms of Use and in accordance with the law.

Account termination

5.1. Your account may be terminated in the following cases:

(a) at any time, with your request (through the functionality on the Site);

(b) for a long period of non-use of the account (more than 2 years);

(c) in the event of suspected breach of these Terms by you, the other terms and conditions provided by the Site or by law;

(d) in other cases, at the discretion of AVTOBUS.BG, with prior notice.

5.2. Your account may be suspended in the following cases:

(a) in the event of suspected breach of these Terms by you, the other terms and conditions set out in the Site or the law;

(b) upon request by a competent public authority;

5.3. Upon closing an account and terminating the contract, the data stored on the Site is deleted. In the event of a legal dispute or proceeding requiring the retention of data and / or a request from a competent public authority, it is possible to retain the data until the final conclusion of the dispute or proceeding before all instances.

Changes

6.1. AVTOBUS.BG reserves the right to add new Services, modify or remove existing Services without the need for prior notice.

6.2. These Terms may be modified in connection with the development, addition of new, modification or termination of the Services or in the case of legislative changes. When making changes, they will be brought to your knowledge and posted here.

6.3. Because the Services may only be used under the current Terms, in the event that you do not agree with them, we do not have the technical ability to provide you with the Services on the Site. If you do not agree to the Terms, you must not use the Site. If you wish, you can close your account and terminate the contract at any time.

Others

7.1. These General Terms govern the relations between the parties, replacing all previous General Terms. Additional agreements may only be entered into by the intended functionality on the Site or by the signing on both sides of an explicit written agreement provided by AVTOBUS.BG.

7.2. Except for intentional or gross negligence, AVTOBUS.BG shall not be liable for any damages or loss of profits arising from:

(a) use or inability to use the Site and/or Services;

(b) restrict, suspend, delete or block your account and/or your content in accordance with these Terms.

7.3. The contract is concluded in Bulgarian. Disputes on these Terms will be settled by the competent Bulgarian court in Sofia.

7.4. In the event that any clause in these Terms and Conditions proves invalid, this will not invalidate any other clause.

7.5. The legislation of the Republic of Bulgaria shall be applied on outstanding issues.
